Responsibility before activity

The commercial model must be explicit.

Recruitment, temporary labour supply and payroll-processing support are legally different activities. Before an engagement begins, the contract and worker documentation must identify the parties, the actual service and each operational responsibility.

A contract can allocate tasks, but it cannot remove a statutory duty from the party on whom the law places it. CP Protect does not imply that it is the employer, PAYE operator or payroll bureau in every engagement; its actual role must be lawful and confirmed in writing.

Three possible service roles

Describe what CP Protect actually does in each engagement.

A proposal may contain one role or a lawful combination. It must not blur the party that finds work, engages the worker, supplies labour, operates PAYE or processes data.

Recruitment introduction

CP Protect may introduce a work-seeker for direct engagement by a hirer. The written terms must distinguish this employment-agency role from temporary labour supply.

Temporary labour supply

If CP Protect engages and supplies a temporary work-seeker to a hirer, employment-business duties apply, including the applicable worker-information and payment responsibilities.

Payroll-processing support

CP Protect may process authorised data under a defined client scope. That administrative role does not by itself determine employment, PAYE, pension or data-controller status.
